Appeals

If, following a Hearing, you wish to contest the decision of the Employment Tribunal you may appeal to the Employment Appeal Tribunal (“EAT”).
 
However before your appeal is heard, the EAT will consider first your reasons for appealing. These can only be on points of law which you feel the Employment Tribunal made in error, or did not take into consideration when coming to its decision. If the EAT consider that you have insufficient grounds to appeal, they will not allow the appeal to be heard.
 
If you are dissatisfied with the outcome of the EAT decision, you may appeal again to the Court of Appeal.
 
If you are still not satisfied you may appeal still further; this time to the House of Lords.
 
The final place you may appeal to is the European Court.
 
The rules regarding what legal costs you are liable for when appealing are different to the Employment Tribunal. Once a claim goes into the Appeal process, the losing party at each of the Appeal Hearings will be responsible for all reasonable legal costs of both parties relating to that particular Appeal Hearing.
